<p> In light of the White House extension on its &#8220;COVID 19 vaccine mandate&#8221; to January 4, 2022, ACL would like to share information we have received from the DC-based Federal Forest Resource Coalition(FFRC) about the Vaccine mandate as it relates to federal timber contractors: Key passage in FFRC message below: BEGIN: At the recent Federal Timber Purchasers Meeting in Salt Lake City, UT, we heard from the U.S. Forest Service on their efforts to implement the Federal Covid-19 vaccine mandate for Federal contractors.  While final, written, official guidance is still not out, we heard for the first time in a public setting that the Forest Service believes the mandate does NOT apply to normal (2400-6) timber sale contracts or Integrated Resource Timber Contracts. END (But some contracts may still HAVE the vaccine mandate. See FFRC e-mail below:)   And: BEGIN: The bottom line is we still need to wait and see what the final guidance looks like. There are still plenty of unanswered questions – including how the GNA (Good Neighbor Authority) mandate is likely to conflict with diametrically opposite policies adopted by certain states which currently have active GNA programs. However, the initial report that “normal” timber sales don’t trigger the vaccination mandate is good news. ACL has responded to FFRC with thanks, but letting them know that the federal government should include in this flexibility any contract that has cutting sawlogs, biomass, firewood like IRSC,TC’s,all 2400-2,4,6 &#8212; in short, any and all contracts that are under partnership agreements. Timber sales contracts alone will not &#8220;meet the need&#8221; to help all of our members and other loggers. ACL is working with FFRC and other organizations to press this point. Lawyers are involved as well. <br>THE FFRC MEMO OF OCTOBER 28, 2021, IN FULL <br> Re:                 Update on Vaccine Mandate for Federal Contractors At the recent Federal Timber Purchasers Meeting in Salt Lake City, UT, we heard from the U.S. Forest Service on their efforts to implement the Federal Covid-19 vaccine mandate for Federal contractors.  While final, written, official guidance is still not out, we heard for the first time in a public setting that the Forest Service believes the mandate does NOT apply to normal (2400-6) timber sale contracts or Integrated Resource Timber Contracts. The Forest Service Washington Office reported that final guidance is subject to change, and that once finalized (likely in a few weeks), they will host a series of webinars to provide additional information and answer questions. Each Federal agency is free to make their vaccine requirements for contractors more stringent than the President’s September Executive Order. The Forest Service intends to follow the order “as written,” and therefore they are making a distinction between service/procurement contracts (which includes Integrated Resource Service Contracts), versus a Timber Sale, which is a disposal contract, and therefore isn’t covered by the Executive Order. The mandate does apply to IRSCs – contracts that fall under the Service Contract Act &#8211; if they are over the $250,000 threshold. It appears the mandate does apply to Good Neighbor Agreements (GNA) with States but does NOT apply to the sales the state sells under the GNA, unless the state makes it a requirement. It does apply to GNA service contracts (which is funded with direct FS funds).  Again, subject to change when we see the final written policy, the Forest Service said:</p>



<ul class="wp-block-list"><li>The mandates does not apply to existing contracts, unless the contract is extended.&nbsp;</li><li>The vaccine mandate only applies to road cost-share agreements if the Forest Service portion is over the $250,000 threshold, which typically doesn’t occur under cost-share agreements.</li><li>Contractors that fall under the mandate will have to provide a list of employee names that are vaccinated but will not be asked to provide physical proof (copy of vaccine card, medical records, etc.). Physical proof should be retained by individual companies.</li><li>Employee lists of vaccinated employees will be required at the time of contract award.&nbsp;</li></ul>



<p> The bottom line is we still need to wait and see what the final guidance looks like. There are still plenty of unanswered questions – including how the GNA mandate is likely to conflict with diametrically opposite policies adopted by certain states which currently have active GNA programs. However, the initial report that “normal” timber sales don’t trigger the vaccination mandate is good news. Whether or not the vaccine mandate for Federal contractors applies to your timber sale contracts, most sawmilling and other wood products companies may still be covered by the still yet to be released OSHA “Emergency Temporary Standard” requiring companies with 100 or more employees to get them all vaccinated. Yesterday, elements of the business community visited the White House to plead for “flexibility”. White House Coronavirus Task Force leader Jeffery Zients was quoted in the Washington Post today, saying <br>&#8220;To be clear, we’re creating flexibility within the system. We’re offering people multiple opportunities to get vaccinated. There is not a cliff here.” Bottom line is we still need to see the written contractor vaccine policy, and we’re still awaiting the “emergency” standard announced 49 days ago. While FFRC will keep you updated on what we learn, it’s imperative that companies seek out competent legal counsel to fully understand their rights and responsibilities under these mandates.<br>Associated California Loggers will remain involved in these efforts.</p>

All unvaccinated workers must begin wearing masks by Dec. 5 and provide a negative Covid test on a weekly basis after the January deadline, according to the requirements. Companies are not required to pay for or provide the tests unless they are otherwise required to by state or local laws or in labor union contracts. Anyone who tests positive is prohibited from going into work.Companies also have until Dec. 5 to offer paid time for employees to get vaccinated and paid sick leave for them to recover from any side effects. OSHA, which polices workplace safety for the Labor Department, will provide sample implementation plans and fact sheets among other materials to help companies adopt the new rules.OSHA will also conduct on-site workplace inspections to make sure companies comply with the rules, a senior administration official said. Penalties for noncompliance can range from $13,653 per serious violation to $136,532 if a company willfully violates the rules. The vaccine mandate, which covers 84 million people employed in the private sector, represents the most expansive use of federal power to protect workers from Covid-19 since the virus was declared a pandemic in March 2020. The Centers for Medicare and Medicaid Services, the federal government’s health insurance plans for the elderly and poor, are also requiring the 76,000 health-care facilities that participate in the programs to ensure their workers are fully vaccinated by Jan. 4, affecting some 17 million employees, senior administration officials said. Facilities that violate the mandate could be at risk of losing their funding, they said.The Labor Department developed the business mandate under emergency authority that shortcuts the process for issuing new workplace safety standards, which normally take years. OSHA can use its emergency authority when the Labor secretary determines workers face a grave danger from a new hazard, in this case Covid. They point to the growing level of vaccination and natural immunity in the U.S. from previous infections, and mitigation measures already taken by many businesses in the workplace. The Biden administration could now face legal challenges on two fronts, from those who want the mandate overturned and those who want it expanded. It’s unclear whether the mandates will survive legal challenges. OSHA emergency safety standards have a mixed track record in court. Before the pandemic, the agency had not issued an emergency standard since 1983. Courts have postponed or fully overturned four of the 10 emergency safety standards issued by OSHA in its 50-year history. A fifth was partially vacated.</p>

Both carriers as well as JetBlue and Alaska said they would mandate vaccines, complying with the order.American and Southwest have told staff they would need to receive their second shot of a two-dose vaccine by&nbsp;Nov. 24, the day before Thanksgiving and one of the busiest travel days of the year. <ol class="wp-block-list"><li>COVID-19 vaccination of covered contractor employees, except in limited circumstances where an employee is legally entitled to an accommodation;</li><li>Compliance by individuals, including covered contractor employees and visitors, with the Guidance related to masking and physical distancing while in covered contractor workplaces; and&nbsp;</li><li>Designation by covered contractors of a person or persons to coordinate COVID-19 workplace safety efforts at covered contractor workplaces.&nbsp;</li></ol>

<ul class="wp-block-list"><li>The new requirements will be reflected in federal contracts awarded&nbsp;afterOctober 15&nbsp;(contracts awarded prior to&nbsp;October 15&nbsp;where performance is ongoing – the requirements must be incorporated at the point at which an option is exercised or an extension is made).</li><li>The requirements must be incorporated into&nbsp;new&nbsp;contracts awarded on or&nbsp;after November 14(between October 15 and November 14, agencies must include the clause in the solicitation and are encouraged to include the clause in contracts awarded during this time but are not required to do so unless the solicitation for the contract was issued on or&nbsp;after October 15).</li></ul>



<p>&nbsp;Observations:</p>



<ul class="wp-block-list"><li>The new requirements are sweeping and have broad and significant implications for all federal contractors, regardless of business size.&nbsp;We strongly recommend members read the hyperlinked documents below which provide important definitions (e.g. “covered contract,” “covered contractor employee,” “Federal workplace,” etc.), additional guidance, and FAQs.</li><li>We are working with our partner organizations, such as AFRC and FFRC, to seek greater clarification about the requirements and impacts to existing and new Federal timber contracts.&nbsp;</li><li>We expect litigation and will share updates on how legal challenges may impact implementation of the requirements.&nbsp;&nbsp;</li></ul>

In order to dispel that concern could you please incorporate the information below in an e-mail to your members?<br />The American Loggers Council has been very involved in the $200 million Pandemic Assistance for Timber Harvesters and Haulers (PATHH) program. The application period is now open. To date 3000 applications have been submitted and nearly $2 million in initial payments have been disbursed. Prior American Loggers Council surveys and estimates indicate that far more are eligible. The application is quite simple, only one and a half pages. The local Farm Service Agency (FSA) offices are prepared to assist loggers and truckers with the application and process. There is probably not a simpler federal assistance program. The deadline to apply is October 15<sup>th</sup>, 2021, but don’t wait until the last minute, apply now. “I’ve worked with federal grants before and this application was by far the simplest I have ever applied for. I don’t know how it could have been any simpler. On a scale of 1-10, with 10 being very difficult, this program and application is a 1. <p class="MsoNormal"><strong>USDA Announces Pandemic Assistance for Timber Harvesters and Haulers</strong></p>



<p class="MsoNormal"><em>Farm Service Agency Will Begin Accepting Applications&nbsp;on July 22</em></p>



<p class="MsoNormal"><strong>WASHINGTON, July 20, 2021</strong>&nbsp;— The U.S. Department of Agriculture (USDA) is providing up to $200 million to provide relief to timber harvesting and timber hauling businesses that have experienced losses due to COVID-19 as part of USDA’s Pandemic Assistance for Producers initiative. Loggers and truckers can apply for assistance through USDA’s Farm Service Agency (FSA)&nbsp;July 22 through Oct. 15, 2021. The Pandemic Assistance for Timber Harvesters and Haulers program (PATHH) is administered by FSA in partnership with the U.S. Forest Service.</p>



<p class="MsoNormal">&nbsp;</p>



<p class="MsoNormal">The Consolidated Appropriations Act, 2021, authorized this critical assistance for the timber industry. Timber harvesting and hauling businesses that have experienced a gross revenue loss of at least 10% during the period of&nbsp;Jan. 1&nbsp;and Dec. 1, 2020, compared to the period of&nbsp;Jan. 1&nbsp;and Dec. 1, 2019, are encouraged to apply.</p>



<p class="MsoNormal">&nbsp;</p>



<p class="MsoNormal">“USDA’s Pandemic Assistance for Producers initiative promised to get financial assistance to a broader set of producers and today’s announcement delivers on that promise,” said Secretary Vilsack. “On top of the existing challenges associated with natural disasters and trade, the pandemic caused a major disruption for loggers and timber haulers including lack of access to wood processing mills. This industry plays a critical role in our nation’s economy and we are proud to support these hard-working loggers and truckers as they get back on track.”</p>



<p class="MsoNormal">&nbsp;</p>



<p class="MsoNormal">“Like many facets of the agriculture industry, the logging industry has experienced its share of financial hardships throughout the pandemic,” said FSA Administrator Zach Ducheneaux. “We’re happy to work with the U.S. Forest Service to develop this new program to provide critically needed support.”</p>



<p class="MsoNormal">&nbsp;</p>



<p class="MsoNormal">“We’ve heard from loggers and truckers whose livelihoods were significantly impacted this past year by the COVID-19 pandemic, and we are pleased that USDA can help alleviate some of the financial burden,” said Forest Service Chief Vicki Christiansen. “I encourage those logging and log-hauling businesses hardest hit by the pandemic to learn more about the assistance offered through this new program.”</p>

<p class="MsoNormal"><strong>Program Details</strong></p>



<p class="MsoNormal">To be eligible for payments, individuals or legal entities must be a timber harvesting or timber hauling business where 50% or more of its gross revenue is derived from one or more of the following:</p>



<p class="MsoNormal">·&nbsp;&nbsp;&nbsp;Cutting timber.</p>



<p class="MsoNormal">·&nbsp;&nbsp;&nbsp;Transporting timber.</p>



<p class="MsoNormal">·&nbsp;&nbsp;&nbsp;Processing of wood on-site on the forest land (chipping, grinding, converting to biochar, cutting to smaller lengths, etc.).</p>



<p class="MsoNormal">Payments will be based on the applicant’s gross revenue received from Jan. 1, 2019, through Dec. 1, 2019, minus gross revenue received from Jan. 1, 2020, through Dec. 1, 2020, multiplied by 80%. FSA will issue an initial payment equal to the lesser of the calculated payment amount or $2,000 as applications are approved. A second payment will be made after the signup period has ended based upon remaining PATHH funds.</p>



<p class="MsoNormal">&nbsp;</p>



<p class="MsoNormal">The maximum amount that a person or legal entity may receive directly is $125,000.</p>

<p class="MsoNormal"><strong>Applying for Assistance</strong></p>



<p class="MsoNormal">Loggers and truckers can apply for PATHH&nbsp;beginning on July 22&nbsp;by completing form FSA-1118, Pandemic Assistance for Timber Harvesters and Haulers Program application, and certifying to their gross revenue for 2019 and 2020 on the application. Additional documentation may be required. <p>ONE: <strong>This development stems from the continuing COVID-19 enforcement situation in California and Nevada.</strong> In Nevada, the 2021 Associated California Loggers Annual Meeting has been cancelled and no classes can be held there.  In California, the two logging conferences, we understand, are currently reviewing their options – we are told that both conferences will take place later in 2021, but not in February and March when they are usually held.</p>
<p>However, with the ACL Annual Meeting cancelled and the logging conference dates “in flux,”, it was determined that ACL’s ProLogger program (administered by this Association as a separate entity from the conferences) needed a “waiver and extension” for 2021.</p>
<p><strong>TWO: ACL Immediate Past President Mike Albrecht and Executive Director Eric</strong> <strong>Carleson</strong> made this presentation before the the California state implementation committee <strong>and were successful in obtaining this “waiver and extension.”</strong></p>
<p>THREE: <strong>This “waiver and extension” will be honored by such employer companies </strong>as Sierra Pacific Industries, Humboldt Redwood Company, Mendocino Redwood Company, and Roseburg Forest Products.</p>
<p>FOUR:  <strong>Proof of First Aid/CPR training(a valid card) is required for ProLogger certification.</strong> Though you will not have to take classes in 2021 if you are on the 2020 ProLogger list, <strong>your First Aid/CPR requirements are under the jurisdiction of the state (Cal OSHA) and you will want to find out what those requirements are for 2021.    </strong></p>

<p>WASHINGTON – The U.S. Small Business Administration (SBA), in consultation with the Treasury Department, announced today that the Paycheck Protection Program (PPP) will re-open the week of January 11 for new borrowers and certain existing PPP borrowers. To promote access to capital, initially only community financial institutions will be able to make First Draw PPP Loans on Monday, January 11 and Second Draw PPP Loans on Wednesday, January 13. The PPP will open to all participating lenders shortly thereafter. Updated PPP guidance outlining Program changes to enhance its effectiveness and accessibility was released on January 6 in accordance with the Economic Aid to Hard-Hit Small Businesses, Non-Profits, and Venues Act.</p>
<p>This round of the PPP continues to prioritize millions of Americans employed by small businesses by authorizing up to $284 billion toward job retention and certain other expenses through March 31, 2021, and by allowing certain existing PPP borrowers to apply for a Second Draw PPP Loan.</p>
<p>“The Paycheck Protection Program has successfully provided 5.2 million loans worth $525 billion to America’s small businesses, supporting more than 51 million jobs,” said Secretary Steven T. Mnuchin. “This updated guidance enhances the PPP’s targeted relief to small businesses most impacted by COVID-19. We are committed to implementing this round of PPP quickly to continue supporting American small businesses and their workers.”</p>
<p>“The historically successful Paycheck Protection Program served as an economic lifeline to millions of small businesses and their employees when they needed it most,” said Administrator Jovita Carranza. “Today’s guidance builds on the success of the program and adapts to the changing needs of small business owners by providing targeted relief and a simpler forgiveness process to ensure their path to recovery.”</p>
<p>Key PPP updates include:<br />
· PPP borrowers can set their PPP loan’s covered period to be any length between 8 and 24 weeks to best meet their business needs;<br />
· PPP loans will cover additional expenses, including operations expenditures, property damage costs, supplier costs, and worker protection expenditures;<br />
· The Program’s eligibility is expanded to include 501(c)(6)s, housing cooperatives, direct marketing organizations, among other types of organizations;<br />
· The PPP provides greater flexibility for seasonal employees;<br />
· Certain existing PPP borrowers can request to modify their First Draw PPP Loan amount; and<br />
· Certain existing PPP borrowers are now eligible to apply for a Second Draw PPP Loan.<br />
A borrower is generally eligible for a Second Draw PPP Loan if the borrower:<br />
· Previously received a First Draw PPP Loan and will or has used the full amount only for authorized uses;<br />
· Has no more than 300 employees; and<br />
· Can demonstrate at least a 25% reduction in gross receipts between comparable quarters in 2019 and 2020.</p>

<div>&#8220;The United States Senate passed a bill to extend the filing deadline for Paycheck Protection Program(PPP) loans on Tuesday evening, June 30, just hours before the Small Business Association (SBA) was set to stop accepting loan applications.</div>
<div>Senator Benjamin Cardin, ranking member of the Small Business and Entrepreneurship Committee, asked for unanimous consent on a bill that would EXTEND THE PROGRAM&#8217;S DEADLINE FROM JUNE 30 TO AUGUST 8.   He was met with no objections, sending the legislation over to the House of Representatives.</div>
<div>But unless and until the House OKs the language, the SBA will stop accepting applications to the program, which was extremely popular early on in the COVID-19 pandemic to keep small businesses afloat during the mass shutdowns initiated to slow the spread of the disease.</div>
<div>The PPP provides small businesses forgivable loans of up to 10 weeks&#8217; worth of payroll to use mostly on paying workers and some other fixed costs. If the businesses follow the program&#8217;s guidelines, their debts are forgiven.  Money used for other purposes turns into low income loans with five-year terms.</div>
<div>But in recent weeks, applications to the PPP have declined, and the amount of loan money available increased as some borrowers returned their loans or paid them back early.  Enactment of a bill to loosen the program&#8217;s requirements and extend the period in which the forgivable loans could be spent, did little to increase demand for the SBA money. It&#8217;s unclear whether many small businesses would take advantage of a later deadline.</div>
<div>Small Business committee chairman Marco Rubio, an architect of the program, said he wants to repurpose the funds to help the hardest hit small businesses. That idea would allow businesses demonstrating particularly large drop offs in revenue to apply for additional forgivable loans wherein the portions not used for payroll would be converted into long-term, low-interest loans.</div>

										<content:encoded><![CDATA[<p>Some of our members have signed up for the &#8220;Paycheck Protection Program&#8221; by which the federal government provides money to businesses to restore employee and payroll levels that had been reduced due to COVID-19.</p>
<p>Since then, new &#8220;clean-up&#8221; legislation has been passed and signed, and positive changes have been made &#8212; crucially in the area of &#8220;flexibility.&#8221;</p>
<p>KEY: A deadline of 8 weeks or June 30, 2020, whichever comes first has been EXTENDED to a deadline of 24 weeks or December 31, 2020 &#8212; to restore their employee and payroll levels. Other changes can be found in the two links below:</p>

<p><u></u><u></u>&#8220;As more financial impacts are being felt around the country as both a direct and indirect result of the COVID-19 pandemic, the members of the American Loggers Council have coalesced around a proposal to members of Congress that would provide financial assistance directly to both professional timber harvesting businesses and log trucking businesses.&#8221;<u></u><u></u></p>
<p>&#8220;While the US House of Representatives have already passed their version of the next round of stimulus funding, the US Senate has put a hold on future funding until they have a chance to see some of the results of those appropriations that have already gone out. Many logging and trucking businesses have been able to apply for and receive Payroll Protection Program funding as well as bridge loans that are being made available through the Small Business Administration(SBA.)&#8221;<u></u><u></u></p>
<p>&#8220;Another program being offered is the Business and Industry CARES Act Program being administered through USDA Rural Development which allows rural businesses to receive working capital loans from lenders at negotiated rates with financial institutions.&#8221;<u></u><u></u></p>
<p>&#8220;What the leadership of the American Loggers Council is proposing is a LOW INTEREST LOAN TO BOTH LOGGING AND LOG HAULING BUSINESSES THAT IS BASED ON LOST PRODUCTION OR REVENUE DUE TO LOST MARKETS, CURTAILED PRODUCTION AND OTHER EVENTS RELATED TO THE COVID-19 PANDEMIC&#8230;that would not duplicate those benefits received through the Payroll Protection Program.&#8221;<u></u><u></u></p>
<p>&#8220;We have a very short time frame in which to try and push this program into THE NEXT STIMULUS PACKAGE, and with YOUR HELP, we believe that we can make this happen.&#8221;<u></u><u></u></p>
<p>&#8220;If we are successful, this will be the FIRST TIME that both logging businesses and log hauling businesses have become available for low interest and PERHAPS FORGIVABLE LOANS that would assure that contractors can have the opportunity to remain in business over the next 12 months and to adjust their operations as markets begin to stabilize.&#8221;<u></u><u></u></p>
<p>&#8220;This effort is a great example of what we can accomplish when we are all working together towards a common goal, BUT WE STILL NEED YOUR HELP.&#8221;<u></u><u></u></p>
